Synopsis (short abstract) The origins of this meeting can be traced to the Declaration of Rabat adopted at the Ministerial Conference on Fisheries Cooperation among African States bordering the Atlantic Ocean, held in Rabat on 30 March and 1 April 1989, and to the meeting of the Follow-up Committee, which took place on 29 to 31 May 1990. At that meeting of the Follow-up Committee a first draft of a Convention was presented. This draft was circulated to interested international organizations, including FAO, for comment. S ubsequently, the Moroccan Minister for Marine Fisheries and Merchant Marine invited the Director-General of FAQ to host a workshop on the legal aspects of the draft convention concerning fisheries cooperation amongst African States bordering the Atlantic Ocean in preparation for the Ministerial Conference scheduled to take place in Dakar in the first week of July 1991.

    This document was prepared by project GCP/RAF/302/EEC “Improvement of the legal framework for fisheries cooperation, management and development of coastal States of West Africa”. In the 1960s and 1970s, West African states were among the strongest proponents of change under the old law of the sea regime which they viewed as unable to provide the legal structure necessary to get the maximum benefits from their maritime resources. This paper seeks to examine legal aspects regarding the implementat ion of monitoring, control and surveillance (MCS) measures as well as issues concerning the prosecution of fisheries offences in the West African region. It begins with an acknowledgement of the policy considerations which play a part in the choice of MCS measures. These considerations can include questions of cost, vessel nationality and even the choice of resource management system.

    This technical report summarizes findings and provisional analyses of the data accumulated during the course of the resources survey in the coastal waters of eastern Africa, from Somalia south of the equator to 27°S, including Madagascar and the Mauritius Seychelles Ridge. Due to late arrival of authorization, Madagascar and Somalia waters were eventually excluded from the survey programme. Provisional results are presented in tabular form supplemented by fish distribution/density maps. The surv ey data, after further analyses, will be presented in a technical data report to follow.
