Synopsis (short abstract) Land and labour rights can intersect in multiple ways. Investments in large-scale plantations often entail trade-offs between job creation and compressions of land rights. Also, labour relations can involve tenure dimensions, for example where estate managers sublet plots for workers to complement wages with food production for their family or local markets. Casual or seasonal employment and limited application of labour legislation can create precarity not only in workers’ employment but also in their tenure rights, with entire families dependent upon the employment status of one individual – thus perpetuating generational labour obligations, affecting relations within the family and the distribution of tasks within the household, and disproportionately impacting women. International policy discourses have often neglected these intersections. This brief explores these issues and reflects on the role of the Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests in the Context of National Food Security (VGGT), and of international labour conventions, in addressing them.

    Human rights law offers a framework on rights that are universal to all, bound in international and regional treaties signed by States. While there is no explicit universal right to land in these treaties, the Office of the United Nations High Commissioner for Human Rights (OHCHR) considers land as a key element to realise many human rights. For rural people who rely on agriculture for their livelihoods, land implicitly relates to the right to property, food, housing and work, to name just a few. Key treaties make that clear, including the Universal Declaration of Human Rights (UDHR), and the International Covenant on Economic, Social and Cultural Rights (ICESCR). A focus on land tenure security can help to fulfil human rights obligations. Furthermore, it remains possible that land itself becomes a universal right in the future.

    The VGGT Popular Version for Communal Land Administration was developed to support the Parliament of Namibia in delivering training to traditional authorities and regional institutions to enhance their capacity to administer communal land within their jurisdictions. This was carried out in line with the Communal Land Reform Act, Act 5 of 2002 and the resolutions of the 2nd National Land Conference. The Popular Version outlines 14 pertinent land governance issues in Namibia’s communal areas. These issues which were validated by the MAWLR are discussed briefly and followed by identifying key messages of the VGGT that are relevant within the context of communal land administration in Namibia.
