El nivel de información que se requiera deberá ser adecuado al propósito del país importador y no imponer cargas innecesarias al país exportador o a la empresa exportadora, ni debería existir requisito alguno que entrañe la divulgación de información comercial confidencial, a menos que sea pertinente para la salud pública. Los certificados deberán exigir sólo cuando sea necesario garantizar la inocuidad del producto o las prácticas comerciales equitativas.
ÁMBITO DE APLICACIÓN
3. Esta directriz se ocupa del diseño y uso de certificados oficiales [y de certificados oficialmente reconocidos] en los que se declaran los atributos de los alimentos que se presentan al comercio internacional. Los certificados exigirán sólo cuando sea necesario garantizar la inocuidad y salubridad de los productos, o favorecer el comercio.
4. Estas directrices no se ocupan de temas relacionados con los aspectos fitosanitarios y zoosanitarios puesto que ellos no están incluidos en el mandato del Codex. Sin embargo se reconoce que en la práctica comercial los certificados pueden contener información relacionada con estos aspectos.
5. Estas directrices prevén la posibilidad de utilizar certificados de papel en formato electrónico.
DEFINICIONES
Se entiende por Certificados los certificados emitidos por un organismo oficial u oficialmente reconocido de un país exportador, de conformidad con los requisitos de un país importador.

Se entiende por requisitos[25] los criterios establecidos por las autoridades competentes con respecto al comercio de alimentos que se refieren a la protección de la salud pública, la protección del consumidor y las condiciones relacionadas con las prácticas equitativas del comercio.
PRINCIPIOS
6. Los certificados se exigirán sólo cuando esto fuese necesario para garantizar la inocuidad del producto, o para facilitar el comercio. El fundamento y los requisitos para la certificación de las exportaciones se deberán notificar de manera transparente, además de aplicarse en forma coherente y no discriminatoria. Los certificados deberían diseñarse y utilizarse de modo que:

7. Los certificados deberán contener una declaración del organismo oficial de certificación, u oficialmente reconocido, y estar debidamente firmados y sellados por un funcionario autorizado a tal efecto por la autoridad competente. El certificado deberá identificar claramente al organismo certificante con su membrete y/o logotipo.
8. Todos los formularios de certificados oficiales deberán tener un solo número de identificación, estar impresos sin ambigüedades y haber sido escritos en un idioma o idiomas que los funcionarios encargados de la certificación y la autoridad receptora puedan entender totalmente. La autoridad competente deberá llevar un registro con los números únicos de identificación asignados a los lotes de certificados impresos, que podrá vincularse a la distribución de los mismos. 9. El certificado deberá ser identificable de manera exclusiva, y estar impreso por lo menos con una copia para uso de la autoridad encargada de la certificación y para que ésta la retenga durante un período adecuado. Se podrán emitir copias adicionales en forma oficial impresa o en fotocopia. En todos los casos, el certificado debe ser claro y llevar, por ejemplo, una marca que indique que es original o copia.
10. Los certificados, de cualquier tipo, deberán estar diseñados de manera que se reduzca al mínimo el riesgo de fraude (por ejemplo, mediante el uso de papel filigrana, de papel que no pueda ser fotocopiado, u otras medidas de seguridad).
11. Cuando los formularios oficiales se produzcan en forma física, deberán ocupar una hoja de papel o, cuando se requiera más de una página, deberá prepararse de tal manera que dos o más páginas formen parte de una hoja de papel completa e indivisible. Cuando esto no sea posible, el funcionario certificador deberá firmar cada hoja individual por separado, y/o cada página deberá estar numerada para indicar que se trata de una página específica de una secuencia finita (por ejemplo, la página 2 de 4 páginas).
12. Los certificados deberán incluir una referencia clara a cualquier requisito exigido para el producto que se certifica.
13. El certificado deberá describir claramente el producto y la remesa a la que corresponde exclusivamente.
14. [Los certificados podrán emitirse después de que se hayan exportado los productos, siempre que existan las medidas adecuadas que aseguren que la remesa a la que el certificado se refiere se ha mantenido intacta, es identificable y no se ha modificado o manipulado de ninguna manera. Dichas medidas pueden incluir el suministro de documentación por parte de otro organismo oficialmente reconocido si la remesa ya no está controlada por la autoridad que emitió el certificado.]/[No se podrá emitir ningún certificado después de que haya cesado el control de la autoridad pertinente sobre la remesa, excepto cuando, en circunstancias excepcionales, sea posible emitir un certificado sobre la base de las garantías de un organismo oficialmente reconocido, si la remesa ha estado bajo supervisión oficial continua durante el transporte.]
15. Deberá aceptarse el uso de medios electrónicos para emitir o transferir los certificados cuando se haya garantizado la integridad del sistema de certificación a satisfacción de las autoridades competentes del país importador y del país exportador. El certificado deberá estar disponible, previa solicitud para su presentación a las autoridades del país importador en forma impresa. Cuando se utilicen certificados electrónicos, los inspectores del país importador deberán disponer de acceso electrónico a los datos relativos a la certificación.

(NOTA: Estos datos no se refieren específicamente referidos a los alimentos, ya que constituyen la información que aparece habitualmente en cualquier conocimiento de embarque de las naves de transporte que llevan productos de un país a otro. Los datos de embarque que aparecen en la documentación oficial de certificación proporcionan un medio para verificar los datos relacionados con el producto.)
16. Los datos del producto que se certifique deberán estar claramente documentados en el certificado, que deberá contener por lo menos la siguiente información:
Declaración de origen
17. Cuando en casos excepcionales justificados por riesgos inmediatos a la salud pública, el país importador exija una declaración sobre el origen de los ingredientes de un producto, el certificado deberá especificar el origen de cualquier ingrediente que no provenga del país exportador.
Atestaciones
18. Las atestaciones específicas de un certificado serán determinadas por los requisitos del país importador. Dichas atestaciones deberán estar claramente identificadas en el certificado y, sin limitarse a ellos, podrán incluir los aspectos siguientes:
Responsabilidades de la autoridad encargada de la certificación
19. La autoridad encargada de la certificación deberá ser designada y facultada de manera adecuada por la legislación o los reglamentos nacionales en forma transparente, para proporcionar la atestación específica que se exija en el certificado.
20. Las autoridades deberá asegurar que sus procedimientos permitan la emisión tempestiva del certificado para evitar interrupciones innecesarias al comercio.
21. Las autoridades deberán disponer de un sistema eficaz para prevenir, en la medida de lo posible, el uso fraudulento de los certificados.
Responsabilidades de los funcionarios encargados de la certificación
22. Todos los funcionarios encargados de la certificación y las partes encargadas de suministrar los datos que se incluyen en los certificados deberán disponer de información y notas de orientación para facilitar la cumplimentación de los mismos.
23. Los funcionarios encargados de la certificación deberán:

24. El importador (consignatario) tiene la responsabilidad de garantizar que el producto se presente a las autoridades del país importador con el certificado original, de conformidad con los requisitos del país importador.
Instrucciones para completar el formulario
25. Los certificados deberán emitirse y presentarse siempre, al exportador o a su agente, en la copia original.
26. Se deberá proporcionar una copia del certificado (claramente rotulada COPIA o DUPLICADO) a las autoridades competentes del país importador y del país exportador, previa solicitud de las partes interesadas.
27. Al firmar un certificado, el funcionario deberá asegurarse de que:

Cuando el funcionario encargado de la certificación extienda un certificado
de reemplazo, por cualquier motivo razonable y suficiente (por ejemplo, si el
certificado se ha dañado en tránsito), dicho certificado deberá
estar claramente rotulado REEMPLAZO antes de ser emitido. El certificado
de reemplazo deberá hacer referencia al número del certificado original.
