Synopsis (short abstract) This is a review of Somalia’s fisheries legislation and managementincluding that of its semi-autonomous regions, with the objective to identify the barriers that prevent implementation of an effective MCS system in Somalia, and to make recommendations on the areas of the Somali fisheries legislation which need to be harmonised. Particular, attention is paid to the regulation regarding fisheries management;the entities that utilise marine resources in Somalia; the administrative systems of fisher ies management in Somalia, and how this interacts in Somalia and its semi-autonomous regions. The specific issues that are discussed include: a) Somalia’s application to establish an Exclusive Economic Zone (EEZ) in the waters under its jurisdiction; and b) The areas of fisheries management that may be required to enhance the effectiveness of and complement the current Somali legislation.

    The Regional Workshop convened by M S Swaminathan Research Foundation in collaboration with the Bay of Bengal Programme of FAO (BOBP) is designed to address these issues and to develop an action plan for saving the remaining coral reefs in the SAARC region. Since its establishment in 1989, M S S R F has given priority attention to the conservation and sustainable use of Coastal Mangrove ecosystems. In many areas, Mangroves, sea grass meadows and coral reefs constitute an integrated ecosystem. Th e Gulf of Mannar Biosphere Reserve represents one such integrated ecosystem. Currently, a detailed action plan is being prepared with assistance from the Global Environment Facility (GEF) and the UN Development Programme (UNDP) for preserving for posterity the biological wealth of the Gulf of Mannar region.

    The Government of Sri Lanka extended its jurisdiction over fisheries to 200 miles in 1977 and requested assistance from the Indian Ocean Programme in revising its fisheries legislation to meet the needs of the new zone. A first report in 1978, “Legal and institutional aspects of fisheries management in Sri Lanka with particular reference to the control of foreign fishing in the EEZ” (Tech. Rep. 22) recommended new draft legislation for the control of foreign fishing operations. The present repor t reviews existing agreements, laws and institutions affecting the management and development of fisheries in Sri Lanka and recommends the adoption of new legislation, including both domestic and foreign fishing operations. Certain principles are recommended for inclusion in the new legislation and suggested drafts of legislation and implementing regulations are appended. Finally the report points out the need for consultation with the fishermen on the new legislation and includes a briefing not e for the carrying out of such consultation. The assistance was financed in part by the Indian Ocean Programme and in part by the FAO/Norway Cooperative Programme.

    This compendium replaces the earlier compendium for the western Pacific region published by FAO in 1984. It differs slightly from its predecessor in that it contains a description at the beginning of each country which sets out basic information concerning the country, the constitution, the legal system and legislative structure, the limits of national jurisdiction, a brief outline of the main points of its fisheries legislation, with particular reference to licensing requirements, conservation and management, and regional and international agreements relating to fisheries. This information is intended to replace the introductory essay at the beginning of the earlier compendium. In addition, there are tables relating to: limits of national jurisdiction, status of 200 mile zones, nationality criteria for fishing vessels, penalties for illegal national fishing, penalties for illegal foreign fishing, penalties for breach of conservation measures, and the status of regional instruments.
