Synopsis (short abstract) This paper discusses the development of a new Land Law in Mozambique 1 , under the leadership of the Technical Secretariat (TS) of the Inter-ministerial Commission for the Revision of Land Legislation (popularly known as ‘the Land Commission’). The TS began work on the new law in August 1995 after first formulating a new National Land Policy. The National Assembly approved the law two years later. Regulations and other instruments needed to implement it were completed in December 1999. Th e Mozambican case offers important lessons at a time when land policy and reform is high on the agenda in many African countries

    The papers contained in this issue have been selected from those presented at a series of workshops, held in 2002 in Hungary, Uganda, Mexico and Cambodia, that were organized by the World Bank jointly with the Department for International Development (DFID), the French Ministry for Foreign Affairs, the German Agency for Technical Cooperation (GTZ), the United States Agency for International Development (USAID), and with FAO, the Inter-American Development Bank (IDB), the African development Bank (AfDB), the European Union (EU), the International Land Coalition, Oxfam, and other bilateral and multilateral agencies. The purpose of these meetings was to provide input into the World Banks Policy Research Report: Land Policies for Growth and Poverty Reduction, which was prepared under the authorship of Klaus Deininger of the World Banks Development Research Group. Building on the discussions at these workshops, this report (which can be accessed at http://econ.worldbank.org/prr/land_policy/ ) identifies general principles for policies to strengthen tenure security, improve the functioning of land markets and ensure socially desirable land use.

    Land reform is never easy but, after many decades without much change in their land laws, there are signs of a mood for change in the countries of the Pacific. With legal systems which place great emphasis on custom, traditional authority and customary land tenures, land policies and legislation in the Pacific must steer a middle course between the need to encourage growth and economic development, and the fundamental importance of protecting the social, political and cultural values reflected b y customary land tenures. Their land systems aim to protect land ownership at the customary group level, and land use at the individual land developer level.
