Synopsis (short abstract) Aquaculture as source for food and income for countries is developing rapidly, especially in developing countries. Management of a sector that has major implications for the aquatic ecosystem, environment and general aquatic health, must be based on a sound regulatory framework that is managed by stable institutional set-ups. There are many considerations that must be taken into account. Public sector institutions play a particularly important role in this regard, which should carefully map out the objectives and goals of a national aquaculture sector. The institutional foundations and the basic legal rules should support and protect aquaculture farmers, encourage investments in the country, ensure that the production sustains regional and international standards for export and consumption, and in general protect the environment. This paper seeks to generally present the most important issues to take into consideration when developing a national aquaculture regulatory framework. In add ition, the latest trends and developments in aquaculture legislation during the past twenty years are presented, as well the most common challenges.

With the multisectorality of family farming at its core and mindful of family farmers’ overwhelming contribution to nutritiously and sustainably feed the world, this publication analyses legislative processes in 12 different areas that are conducive to the agri-food systems transformation for a better production, better environment, better nutrition and better life for all, leaving no one behind.

    Over the last decade, there have been significant changes in the national and international regulatory frameworks governing food control, food safety and food trade. The recognition of the Codex Alimentarius as the benchmark of international food standards for food safety by the World Trade Organization Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement) in 1995 is one of the most significant recent influences on food regulation worldwide, and can be seen as an ac knowledgment of the increasing globalization of food production and food trade. Global outbreaks of food-borne disease, with concomitant media attention and outspoken consumer concerns, have also triggered unprecedented interest in food control and food regulation and in the country-level infrastructures that govern food safety and food quality.

    Review of the legislative framework and jurisprudence concerning the right to adequate food in Nepal 2014

    The Review of the legislative framework and jurisprudence concerning the right to adequate food in Nepal discusses overarching aspects of Nepalese law and jurisprudence dealing with the human right to food. Following a brief discussion of the international legal protection of the right to food in Nepal, the review, in particular provides a critical assessment of constitutional as well as legislative provisions and offers a thorough analysis of Supreme Court jurisprudence pertaining to the right to food. In addition to judicial remedy, the review also covers non-judicial means of remedy against the violation of food rights. This review comes at an opportune moment in the sense that Nepal's constitution-making process is yet to be completed and there are also a number of ongoing legislative and policy initiatives towards protection and promotion of the right to food. This review provides detailed knowledge to concerned stakeholders on normative and implementation gaps in relation to the right to adequate food. With the view of assisting Nepal in this process, the review also offers a set of concrete recommendations, touching upon a wide range of aspects of the human right to adequate food. This work was undertaken under the global project entitled "Integrating the Right to Adequate Food and Good Governance in National Policies, Legislation and Institutions” (GCP/GLO/324/NOR Right to Food at Country Level) run by the Right to Food Team of the FAO. The project aims to address c ountry challenges by promoting human rights-based approach in efforts to achieve food security at all levels, in legislation, policy and programme design and formulation, decision and implementation. By producing this analysis, FAO aims to assist the Government of Nepal, the Constituent Assembly, the Judiciary, the National Human Rights Institutions, and civil society organizations in their initiatives towards advancing the human right to adequate food.
