There is little doubt that IUU fishing has a negative impact on the economic, social and ecological attributes of fisheries and this affects food security. Specifically, illegal, unreported and unregulated (IUU) fishing has contributed to a reduction in food supply, losses of livelihood and state revenue, diminishing fish stocks, and damaging ecosystems, with the most devastating effects felt in developing countries by virtue of their greater vulnerability. These illegal activities form a complex web – from illegal fishing to illegal trade, and persistent catching from unsustainably fished stocks – with the overall objective of making a high profit from illegally caught fish. Members of the FAO Committee on Fisheries have agreed on the need for good practice guidelines for national fishery authorities to prevent, deter and eliminate illegal, unreported and unregulated (IUU) fishing through the effective implementation of flag state responsibilities. The guidelines are wide-ranging and address the purpose and principles, as well as the scope of application, performance assessment criteria and cooperation between states. They are expected to provide a valuable tool to strengthen the compliance of flag states in terms of their international duties and obligations regarding the flagging and control of fishing vessels.

The content of the brochure presents an overview of the Legal template "Implementation of Port State Measures - Legislative template, framework for procedures, role of regional fisheries management organizations", which provides a legislative template and related information for use by port States, as appropriate, to facilitate initial steps, and can be adapted to different legal systems, institutions and instruments. The objective is twofold: to meet those challenges by providing generic legisl ative templates for the development of national legislation; and to explain broader context of port State measures. It also introduces a framework for procedures, and explains the role of RFMOs, including CMMs for tuna and other select RFMOs.

The FAO Agreement of Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing (the PSMA) was approved by the FAO Conference at its Thirty-sixth Session under paragraph 1 of Article XIV of the FAO Constitution. The Agreement, which is binding on the Parties, entered into force on 5 June 2016. As of 17 February 2017, there were 42 Parties to the Agreement, including the European Union. Whilst this represents a major achievement in the global effort to combat illegal, unreported and unregulated (IUU) fishing, the Parties to the PSMA should now work together towards its effective implementation, including by encouraging the non-Parties to adhere to the Agreement.
