Synopsis (short abstract) The Mozambique land law provides statutory recognition of customary land rights and is considered one of the most progressive legislations in Africa. However, the law continues to face implementation challenges, including the realization of equal rights for women and institutional reform. Simply having a progressive law ‘is not enough’ to bring about transformative change in a country. Recognizing these challenges, the Food and Agriculture Organization of the United Nations (FAO) developed a pro gramme to support the legislation through the capacity development of both direct beneficiaries and those responsible for implementing it. This publication, presents an overview of how this programme developed and what it has achieved to date. It highlights the lessons learned from this core element of FAO’s long history of support to the land programme in Mozambique. In particular, the study discusses the challenges facing land and natural resources paralegals in Mozambique today and helps to d efine the parameters for programme assessment by looking at paralegals in different country contexts. It describes how the programme has included training and capacity-development, not just for NGO-sponsored paralegals, but also for district and local government level officials, justice system officers and staff from public sectors working with land and natural resources.

This paper focuses on legal and institutional aspects of children’s property and inheritance rights in Southern and East Africa. Chapter 2 discusses violations of children’s property and inheritance rights and discusses how the spread of HIV/AIDS has contributed to the violations. Chapter 3 assesses several norms of customary law that aim to protect children’s property and inheritance rights as well as the current practices of customary law that—in the context of the HIV/AIDS pandemic—serve to c omplicate and limit children’s ability to maintain their rights. Chapter 4 reviews and assesses a selection of international laws and national laws from the countries in the region that influence children’s property and inheritance rights, emphasizing succession and land laws. Several gaps in national legislation and policy that need to be addressed are identified.

Land Tenure Working Paper 15. This publication brings to light the existing linkages between land tenure and the realization of the right to food. It points out that responsible governance of land requires the adoption of human rights-based approach in order to develop coherent and long term solutions to improve people’s livelihoods. The document presents the legal implications of the right to food at national level and provides a series of examples on the implementation of human rights principl es and obligations into land tenure systems, policies, and institutional frameworks. Presented as a background document for the Latin America Regional Consultation Meeting for the elaboration of the Voluntary Guidelines on Responsible Governance on Tenure of Land and Natural Resources, it aims to encourage discussion and further analysis on the issues presented.

This paper aims to provide a synthesis and commentary with recommendations of the papers given and the discussions which took place at the technical workshop on Improving tenure security for the rural poor in Africa in October 2006. The workshop brought together a wide range of persons from civil society academics, representatives from NGOs the FAO, the principal sponsors of the workshop, and from some donors working on land issues from all over sub-Saharan Africa with an emphasis on Anglophon e Africa. The views expressed in this workshop are of significance. They are not the official positions of governments but they are representative of grass-roots involvement in land relations in Africa and are therefore entitled to respect.
