Synopsis (short abstract) In rural areas, land is the basis for agricultural production and the source for securing natural resources through fishing, hunting, pasturing or other activities. Land is used by many people for different purposes (e.g. for agricultural production, housing, industry, services and government). Land also has social, cultural and political functions related to each country’s history. Because land is used for so many purposes, land and property rights have broad impact on people’s lives and livelihoods. These rights refer to the rules that specify who can do what with which resources and assets, for how long and under what conditions. Collecting plants in a forest, cultivating a plot of land, getting the produce harvested, accessing and extracting natural resources and deciding who should or should not be allowed to collect plants or cultivate a plot of land are all expressions of the exercise of property rights.

This report is based on the proceedings of the Technical Consultation on Gender, Property Rights and Livelihoods in the Era of AIDS, organized by FAO in November 2008. It takes stock of where FAO and its partners are in terms of addressing property rights insecurity and provides a proposed framework through which future action can take place. It focuses on the following dimensions: understanding property rights in the era of AIDS (including key research findings); linkages between gender, proper ty rights and livelihoods; legislation, training of the judiciary and traditional leaders, and para-legal training programmes; advocacy, mobilization of grassroots groups/networks; and political dialogue. Drawing together experiences and expertise on these issues, and identifying research and programme gaps, this report concludes with some key recommendations for future work and priority areas of action.

Safeguarding property rights of vulnerable people is an important policy issue, not least in the quest for poverty reduction in poor societies. This issue has become urgent due to recent developments, including the AIDS epidemic, globalization, climate change and other similar social and natural forces. This study sets out to assess the extent to which property and inheritance rights of widows and orphans are violated or protected in the context of HIV and AIDS in two rural communities in Tanzania. The study takes into consideration two major interrelated aspects: the socio-economic system within which property rights systems are embedded and the constellations of legal pluralism which regulate property rights in Tanzania. While aiming at providing in-depth knowledge on the context and dynamics of the problem, the research goes further to explore the capacity of service providers to protect the property and inheritance rights of women and children.
