Synopsis (short abstract) This document contains the report of the Expert Consultation on Flag State Performance that was held at FAO headquarters, Rome, from 23–26 June 2009. The Experts received a report on the "Expert’s Workshop on Flag State Responsibilities: Assessing Performance and Taking Action" that was organized by the Government of Canada from 25 to 28 March 2008 in Vancouver. The Consultation then considered a number of papers prepared by the experts and commentaries on them including criteria for assessing the performance of flag States, possible actions against vessels flying the flag of States not meeting the criteria for flag State performance, the role of national governments in implementing criteria and actions for flag States performance, the role of regional fisheries management organizations in implementing criteria and actions for flag State performance, the role of international institutions and instruments in implementing criteria and action for flag State performance and assistance to developing countries. The Consultation agreed to recommend to a Technical Consultation that international guidelines on criteria for assessing the performance of flag States and possible actions against vessels flying the flags of States not meeting such criteria should be developed. An assessment process would be an important part of such guidelines. Noting the basis provided by international law for such assessments, the experts agreed on the need for two processes: (i) one for self-assessment and (ii) another for international or multilateral assessment. The latter assessment would have to be undertaken in a spirit of cooperation and be consistent with the 1992 UN Convention on the Law of the Sea. The Consultation agreed upon draft criteria for flag State performance, processes for conducting assessments, post-assessment actions and assistance to developing countries to improve their performance as flag States. The experts considered that these criteria and actions would form an app ropriate framework for review by a Technical Consultation.

    The goals of the Expert Consultation were to advise FAO on the development and implementation of a global record of fishing vessels and to respond to the request from FAO’s Committee on Fisheries to further develop the concept as described in the feasibility study. A comprehensive global record, a potential additional tool to combat illegal, unreported and unregulated fishing, is envisioned as a global database gathering data from many sources in one location. A major obstacle facing fisheries e nforcement bodies is the lack of access to information on vessel identification, ownership and control. Currently, there is no single source containing basic information about fishing vessels of all sizes. The experts expressed a sense of urgency about the need for this tool. They also believed that a global record should be extensive in scope. They recommended interim activities to raise awareness about the global record and further develop some technical issues in advance of the Committee on Fisheries to be held in 2009.

    This document contains the report of the Expert Consultation on the Use of Monitoring Systems and Satellites for Fisheries Monitoring, Control and Surveillance, that was held at FAO headquarters, Rome, Italy, from 24 to 26 October 2006. The Expert Consultation was convened by the Director-General of FAO to review and assess technical, legal and institutional aspects concerning the use of vessel monitoring systems (VMS) and satellites in monitoring, control and surveillance (MCS) with the goal of facilitating the wider use of this type of technology and promoting and strengthening international cooperation among States for its use. The Expert Consultation furthered collaboration with the International Maritime Organization (IMO), as called for in paragraph 90 of the 2001 FAO International Plan of Action to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated [IUU] Fishing. The Experts undertook an inventory and assessment of the status of VMS and satellites in terms of the t echnology and equipment employed and legal and institutional considerations. This work was complemented by a review of options to enhance the use of VMS and satellites in MCS by addressing the enhanced use of technology and strengthening the development and implementation of national legislation and international instruments to foster enhanced international cooperation for the wider use of VMS technology. The Consultation also considered issues relating to the special requirements of developing countries, the use of VMS in support of port State measures, a comprehensive record of fishing vessel and the role of the International MCS Network. The Consultation did not recommend a binding international VMS agreement although additional mechanisms such as an international plan of action, declaration or strategy to guide and facilitate global implementation of VMS might be considered. The Consultation also made recommendations, inter alia, concerning the use of VMS as a MCS tool to combat IU U fishing, the further development and implementation of VMS and the need for MCS to be enhanced particularly with respect to closer cooperation among regional fishery management organizations. The Consultation was funded by the FAO Regular Programme and by the FAO FishCode Programme through the FishCode Trust (MTF/GLO/125/MUL) and the FishCode SIDS Project (GCP/INT/823/JPN), “Responsible Fisheries for Small Island Developing States”.
