Synopsis (short abstract) While the aquaculture sector has seen extraordinary global growth over recent years, it also faces a number of important challenges. Although aquaculture may reduce pressure on wild fish stocks, the fact remains that the sector can also have a range of negative environmental impacts. At the same time, a degraded environment, in particular poor water quality, can adversely affect the health of aquatic animals and plants used in aquaculture and therefore the economic sustainability of the sector. Moreover, if appropriate bio-security measures, in the sense of measures to protect aquatic animal health, aquatic plant health and human health, are not in place (or are not implemented), the sector can be subject to devastating disease outbreaks. It follows that the legal framework for aquaculture should support the development of the sector while at the same time promoting its long term environmental, social and economic sustainability. This requires a balancing act. Overly burdensome legislation may discourage or otherwise hinder investment. At the same time, insufficient regulation may encourage indiscriminate and substandard operations that lead to uncontrollable disease outbreaks, irreparable environmental damage and the economic failure of aquaculture operations with ensuing social costs. Unlike capture fishing, which is regulated largely if not exclusively on the basis of a fisheries law, the legal framework for aquaculture is invariably diverse and complex. Some aspects of aquaculture are addressed in legislation that has aquaculture as its specific or primary focus, such as a chapter in a fisheries law or a stand-alone aquaculture law (described in this document as ‘aquaculture legislation’).

    A Technical Consultation on Legal Frameworks and Economic Policy Instruments for Sustainable Commerc ial Aquaculture in Africa South of the Sahara was held at Arusha, United Republic of Tanzania from 4 to 7 December 2001. It was attended by 16 Members of FAO from south of the Sahara and by one observer from an Intergovernmental organization and seven observers from the private sector. The Consultation examined the major constraints to the development of sustainable commercial aquaculture in s ub-Saharan Africa. It reviewed the status and potential of commercial aquaculture, examined the markets and trade, considered the policy options and the framework of legislation favourable for the development of commercial aquaculture. In addition, the Consultation agreed on a set of Conclusions and recommendations for action at national, regional and international levels which point the way forward. Amongst the recommendations, the Consultation requested FAO to continue its efforts in assis ting the sub-Saharan countries in increasing awareness of the potential of aquaculture and upgrading the skills of the members to enable them to take full advantage of the existing potential.

    This document identifies elements of a legislation that will encourage the emergence of a sustainable commercial aquaculture. The aquaculture law of an individual country must provide the operator with a secure right to conduct aquaculture operations, to the property on which the farm will be located, to good quality water and to the produce. It must also ensure environmental sustainability, through permit or licence systems, without imposing unnecessary costs on applicants. Only proposals with the potential for serious environmental harm should be subjected to a full environmental impact assessment. Environmental supervision must extend to controls over the use of exotic species and products from modern biotechnology including genetically modified organisms, disease control and health management and to any water quality concerns created by the proposed project. To minimise costs, countries are encouraged to adopt a single window approach for the numerous approvals usually required for an aquaculture operation and screen initial applications. They could also consider creating a single agency to promote aquaculture and to monitor the progress of applications. Aquaculture regimes of selected African countries are measured against the elements required to encourage sustainable commercial aquaculture, and improvements that are applicable to all countries in sub-Sahara are suggested.

    Support for the Development of Aquaculture Professions in Morocco - GCP/MOR/054/NOR 2023

    The project was part of the continuing efforts implemented by the Kingdom of Morocco in the fisheries and aquaculture sectors, in line with the Halieutisstrategy. Its objective was to meet growing demand for technical assistance from aquaculture operators and to develop a skilled workforce for the management of planned farms off the Atlantic and Mediterranean coasts. The project, which was to be implemented in two phases, was designed with a view to establishing two demonstration/training stations off Sidi Ifni through a public-private partnership, in fish and shellfish farming respectively. These facilities will serve as a practical basis for the training of trainers, specialized and skilled workers across all aquaculture trades, and will be combined with theoretical training at the Maritime Professional Qualification Center (MPQC) in Sidi Ifni.
