Synopsis (short abstract) Komasacija je visokodelotvoran instrument za upravljanje zemljištem koji omogućava unapređenje strukture poljoprivrednih gazdinstava i poseda, čime se uvećava njihova ekonomska i socijalna efikasnost i ostvaruju koristi za imaoce prava kao za društvo u celini. Pošto komasacija pruža mobilnost u pogledu vlasništva na zemljištu i drugih zemljišnih prava, ona isto tako može da olakša raspodelu novih područja sa posebnim namenama koje ne pripadaju oblasti poljoprivrede, kao što je na primer javna infrastruktura ili zaštita i obnova prirode. Instrumenti komasacije zahtevaju postojanje detaljno izrađenih zakonskih propisa koji su integrisani u nacionalni pravni okvir. Komasacija je zakonski uređen postupak koji predvodi državni organ i koristi se za prilagođavanje vlasničke strukture u ruralnim područjima kroz sveobuhvatnu reorganizaciju parcela, u koordinaciji sa vlasnicima i korisnicima parcela u cilju smanjenja usitnjenosti zemljišta, olakšavanja uvećanja poseda i/ili ostvarivanje drugih ciljeva od javnog interesa, uključujući i obnovu prirode ili izgradnju infrastrukture. Ovaj Pravni vodič pruža detaljne smernice o zakonodavnim pitanjima u vezi sa komasacijom na način koji je u skladu sa Dobrovoljnim smernicama o odgovornom upravljanju sticanjem, raspolaganjem i korišćenjem zemljišnih resursa, ribarskim područjima i šumama u kontekstu nacionalne bezbednosti hrane i međunarodnog prava o ljudskim pravima. Usmeren je na komasaciju u ruralnim područjima i zasniva se na dobrim zakonodavnim praksama u komasaciji u Evropi. Ovaj Pravni vodič je objavljen u saradnji sa Regionalnom kancelarijom FAO za Evropu i Centralnu Aziju.

    This paper focuses on legal and institutional aspects of children’s property and inheritance rights in Southern and East Africa. Chapter 2 discusses violations of children’s property and inheritance rights and discusses how the spread of HIV/AIDS has contributed to the violations. Chapter 3 assesses several norms of customary law that aim to protect children’s property and inheritance rights as well as the current practices of customary law that—in the context of the HIV/AIDS pandemic—serve to c omplicate and limit children’s ability to maintain their rights. Chapter 4 reviews and assesses a selection of international laws and national laws from the countries in the region that influence children’s property and inheritance rights, emphasizing succession and land laws. Several gaps in national legislation and policy that need to be addressed are identified.
