Synopsis (short abstract) Agrifood systems are a major employer of women globally and constitute a more important source of livelihood for women than for men in many countries. However, inadequate legal and customary laws and practices have historically hindered the ability of women to access and control land and natural resources. Half the countries reporting on Sustainable Development Goal Indicator 5.a.2 have weak legal protections for women’s land rights. This Legal Brief provides an overview of gender disparities in Africa, highlights key international and regional instruments applicable, provides examples of legislation enacted in different African countries and offers a checklist for parliamentary action to ensure the disparities are closed where they exist.

This legal note is based on the publication "The protection of the rights of rural women in Latin America and the Caribbean", produced by the Food and Agriculture Organization of the United Nations (FAO) and the Spanish Agency for Cooperation International for Development (AECID) through the Spanish Cooperation Training Center in La Antigua Guatemala. This is a brief document that addresses the international and regional regulatory framework that establishes the rights of rural women, and the constitutional and legislative advances in the matter achieved in the region. The specific laws approved are presented, as well as examples of laws that protect the right to productive resources and services, and the right to participation of rural women, adopted in various countries of the region. The note highlights the work of the Parliamentary Front against Hunger in Latin America and the Caribbean (FPH-ALC) – a network of more than 400 legislators supported by FAO, AECID and the Mexican Agency for Cooperation International for Development (AMEXCID) - and the role of national parliaments to advance in the protection of the rights of rural women. It concludes, bringing recommendations for possible actions from the parliamentary sphere to contribute to the achievement of Sustainable Development Goals 2 and 5 (SDG2 and SDG5), and strengthen the effective guarantee of the rights of rural women.

The report summarises the papers, presentations and discussions of a workshop on failures and achievements at securing women’s land rights. In particular, it addresses the following issues: Land rights and legal reforms,legal aid and land administration practice, women's land rights in an HIV/AIDS context,women's land rights from a food security and livelihoods context. Organised by the FAO and Oxfam, the workshop seeks to establish global and multi-sectoral alliances and multiple strategies as a means of breaking out of the present impasse in this matter.

Goal 5 of the Sustainable Development Goals (SDGs) “Achieve gender equality and empower all women and girls” recognizes the fundamental role of women in achieving poverty reduction, food security and nutrition. Target 5.a aims to “Undertake reforms to give women equal rights to economic resources, as well as access to ownership and control over land and other forms of property, financial services, inheritance and natural resources, in accordance with national laws”. As the designated custodian for Target 5a, FAO has developed a methodology to support countries in monitoring and reporting on progress in the status of women’s land rights protection. Progress in Target 5.a is measured through two indicators that focus on ownership and/or control over land.
