Taking account of paragraph 68 of the report of the twenty-seventh session of the FAO Committee on Fisheries (Rome, Italy, 5? March 2007), the purpose of the Consultation was to prepare a draft text of a legally-binding instrument on port State measures, based on the 2001 FAO Internationa l Plan of Action to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing and the 2005 FAO Model Scheme on Port State Measures to Combat Illegal, Unreported and Unregulated Fishing. The Expert Consultation based its work on a preliminary draft of an agreement on port State measures prepared by FAO. On the basis of this initial draft, the Expert Consultation elaborated a draft agreement on port State measures to prevent, deter and eliminate illegal, unreported and unregulated fishing that will be submitted for consideration and review by the Technical Consultation on Port State Measures to be held in June 2008. However, because of time constraints, the Expert Consultation was unable to review the Preamble, Final Clauses and Annexes of the draft Agreement. The Expert Consultation was hosted by the Government of the United States of America and funded by the FAO Regular Programme, the Government of Norway and the Nordic Council of Ministers through Trust Fund project GCP/INT/032/NOR.

The Consulation was convened by the Director General of the Food and Agriculture of the United Nations upon the recommendation of the twentyse venth session of the FAO Committee on Fisheries. The Technical Consultation finalized the draft Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing on 28 August 2009. The Consultation was funded by the Governments of Australia, Canada, New Zealand, Norway and United States of America.
